The Court of Appeal of Rome therefore accepted Todini's requests, establishing that the assessment of the first instance sentence was not correct, since on the basis of the procedural documents and forensic medical reports, a "condition of mental illness was found, a condition further confirmed by the technical consultancy carried out by the Public Prosecutor during criminal investigations, filed in this phase by the complainant ”. The Court of Appeal therefore establishes that Mrs. Maria Rita Clementi is not able to manage her assets, nor was she clear when she agreed to set up the trust as advised by the two lawyers, on whom investigations were arranged to verify that we acted in the interest of the old woman.

"The outcome of the proceedings before the Court of Appeal - said Federico Vecchio, lawyer of Luisa Todini - was really obvious, precisely because the question proposed by the daughter was not based on rumors, but on documents, some even origin of the same adversary consultants, whose results unequivocally demonstrated, as stated by the Court of Appeal, that Mrs. Clementi was not, as she is not, capable of knowingly managing her own interests ”.
